These Terms of Service govern your use of the Sophiera Studios website and your purchase and use of products and services offered by Sophiera Studios. By accessing this website, purchasing a product, or engaging Sophiera Studios for services, you agree to these Terms of Service.

1. About Our Products

Sophiera Studios provides residential design services, architectural house plans, digital drawing sets, planning resources, and related products and services.

House plans offered through our website are professionally developed residential designs intended to provide a strong foundation for the next stages of a building project.

Unless specifically stated otherwise, plans are not site-specific construction documents and may require additional engineering, modifications, documentation, professional review, or approval before they can be submitted for permitting or used for construction.

2. Digital Products and Delivery

Digital products are delivered electronically or made available for download following purchase.

It is the purchaser's responsibility to provide accurate contact information and to download and securely retain purchased files.

Because digital products provide immediate access to copyrighted intellectual property, purchases of digital products are subject to our Return & Refund Policy.

3. Structural Engineering

Structural engineering is not included with a house plan unless specifically stated otherwise.

Structural requirements depend upon the location and conditions of the individual building site, including factors such as soil conditions, seismic requirements, wind loads, snow loads, foundation conditions, and applicable building codes.

The purchaser is responsible for retaining appropriately licensed professionals when required to review, engineer, adapt, or supplement the plans for the specific project and location.

4. Local Codes, Zoning and Permitting

Building codes, zoning regulations, design standards, permitting requirements, energy requirements, and other regulations vary by jurisdiction and may change over time.

Sophiera Studios does not guarantee that a stock house plan will satisfy every requirement applicable to a particular property or jurisdiction without modification.

Before construction, the purchaser is responsible for confirming applicable requirements with the jurisdiction having authority and retaining any architects, engineers, contractors, consultants, or other professionals required for the project.

5. Plan Modifications

Sophiera Studios plans may be modified to accommodate individual preferences, site conditions, engineering requirements, or local regulations.

Modification services are not included in the original purchase unless specifically stated.

Modifications made by the purchaser or by another professional after delivery are the responsibility of the purchaser and the party performing those modifications. Sophiera Studios is not responsible for errors, omissions, conflicts, or other issues resulting from modifications made by others.

6. Copyright and Ownership

All house plans, designs, drawings, renderings, images, graphics, written materials, downloadable resources, and other original content provided by Sophiera Studios are protected by applicable copyright and intellectual property laws.

Purchasing a Sophiera Studios plan does not transfer ownership or copyright of the design to the purchaser.

Unless expressly agreed otherwise in writing, Sophiera Studios retains all copyrights and intellectual property rights associated with its designs and materials.

Plans may not be copied, reproduced, resold, published, distributed, shared, transferred to another party, or used to create derivative products except as specifically permitted by the license accompanying the purchase or with prior written authorization from Sophiera Studios.

7. License to Use Purchased House Plans

Purchase of a Sophiera Studios house plan grants the purchaser a limited, nonexclusive, nontransferable license to use the plans for the purpose and number of constructions permitted by the specific product or license purchased.

The purchaser may provide necessary copies of the plans to professionals directly involved in the authorized project, including contractors, engineers, consultants, and permitting authorities, solely as necessary to complete that project.

Those copies may not be used for any other project or purpose.

Purchasing a plan does not grant the right to reproduce the design for resale, construct additional homes beyond the permitted license, distribute the plans, or commercially exploit the design.

Additional construction licenses may be available by contacting Sophiera Studios.

8. Renderings and Illustrations

Renderings, photographs, illustrations, floor plan graphics, and other visual representations are provided to communicate the design and character of a home.

Finishes, materials, landscaping, furnishings, fixtures, colors, site conditions, and other elements depicted in visual materials may not be included in the architectural drawing set.

The written product description and plan documentation should be reviewed to determine what is included with each purchase.

9. Construction and Contractor Responsibility

Sophiera Studios does not control construction means, methods, techniques, sequences, procedures, jobsite safety, workmanship, or the performance of contractors, subcontractors, suppliers, or other parties involved in construction.

The contractor and other appropriate professionals are responsible for verifying dimensions and conditions in the field and for performing construction in accordance with applicable codes, approved documents, manufacturer requirements, and accepted construction practices.

Questions or discrepancies concerning the drawings should be addressed before proceeding with the affected work.

10. Professional Services

Any custom design, plan modification, consultation, coordination, drafting, or other professional services provided by Sophiera Studios may be subject to a separate proposal, agreement, scope of work, fee, and terms.

Purchasing a stock house plan does not automatically establish an ongoing professional services agreement beyond the products and services specifically included with that purchase.

11. Refunds and Returns

Digital products are subject to the Sophiera Studios Return & Refund Policy.

Due to the nature of downloadable copyrighted materials, digital products generally cannot be returned, exchanged, or refunded after delivery or access has been provided, except as otherwise stated in that policy or required by applicable law.

12. Website Information

We make reasonable efforts to ensure that product descriptions, dimensions, pricing, availability, and other website information are accurate.

However, errors may occasionally occur. Sophiera Studios reserves the right to correct errors or update website information when necessary.

13. Limitation of Responsibility

Every building project involves conditions and requirements unique to its property, location, jurisdiction, construction team, and intended use.

Sophiera Studios is not responsible for site-specific conditions, engineering performed by others, modifications made by others, contractor workmanship, construction methods, material substitutions, changes in applicable regulations, or the purchaser's failure to obtain required professional services, permits, or approvals.

Nothing in these Terms is intended to exclude or limit liability where such exclusion or limitation is prohibited by applicable law.

14. Changes to These Terms

Sophiera Studios may update these Terms of Service periodically to reflect changes in our products, services, business practices, or legal requirements.

The version posted on this website at the time of purchase will govern that transaction unless otherwise required by law or agreed in writing.
